Does this mean there is hope for H.265 as well ? I didn't try it yet...

I think they have some internal confusion. VideoToolBox is marked prohibited in both docs and in Xcode SDK. AVSampleBufferDisplayLayer is marked (new for tvos) in doc but prohibited in Xcode SDK. If you look at other AVSampleBufferDisplayXXX functions like catpure/record/etc, those make sense. H.265 is a very different store, facetime HAD it but it was removed. Basically H.265 license groups are raping everyone regarding costs and Apple has decided, no way. The costs are really insane. I think H.265 has killed itself because of this high cost of licensing.
